Fifth Street, Suite 400, Winston-Salem, NC 27101 (“Provider”, “Beakpoint Insights”, “we”, “us”, or “our”) collects, uses, and discloses information about you when you visit our website at https://beakpointinsights.com (the “Site”), use our services (the “Services” and “SaaS Services” as defined in our Master Services Agreement), or otherwise interact with us.

By accessing or using the Site or our Services, you agree to this Policy. If you do not agree with our practices described in this Policy, please do not access or use our Site or Services.

  1. Information We Collect
    1. Information You Provide to Us. We collect information you provide directly to us, including:
      1. Account Information: When you register for an account, we collect your name, email address, password, and other information necessary to set up and maintain your account.
      2. Profile Information: Information you provide in your user profile, such as your name, title, company, contact information, profile picture, and preferences.

  3. How We Share Your Information. We may share the information we collect in the following circumstances:
    1. Service Providers. We require these service providers to use your information only as necessary to provide services to us and to implement appropriate security and confidentiality measures.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our business or assets, the information we collect may be transferred as part of that transaction.     3. Legal Requirements. We may access, preserve, and share your information when we believe in good faith that doing so is necessary to:

  4. Data Security. We implement appropriate Administrative Controls, Technical Controls, and Physical Controls, as defined in our Master Services Agreement, to protect the security, confidentiality, and integrity of your information. Our Information Security Program includes, at a minimum:
    1. Reasonable restrictions on access to your data
    2. Appropriate measures to address secure authentication protocols and secure access control mechanisms
    3. The encryption of sensitive data at rest and in transit using industry-standard encryption technologies
    4. Firewall protection and regular testing of security systems, controls, and procedures
    5. Regular backups of data
    6. Prompt patching of security vulnerabilities

      However, no security system is impenetrable, and we cannot guarantee the security of our systems or your information. You acknowledge that:
    7. there are security and privacy limitations inherent to the Internet that are beyond our control; and
    8. the security, integrity, and privacy of any information exchanged between you and us through our Site or Services cannot be guaranteed to be 100% secure.
  5. Your Rights and Choices. Depending on your location, you may have certain rights regarding your personal information, including:
    1. Access and Update. You may access, update, or correct certain information you have provided by logging into your account settings or by contacting us using the information in the “Contact Us” section below.
    2. Opt-out of Marketing Communications. You may opt out of receiving promotional emails from us by following the instructions in those emails or by contacting us. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
    3. Delete Your Information. Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

      2. Direct any service providers to delete your personal information from their records.

        Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

      4. Detect security incidents or protect against malicious, deceptive, fraudulent, or illegal activity
      5. Debug to identify and repair errors
      6. Exercise free speech or ensure another consumer’s right to free speech

      8. Engage in public or peer-reviewed scientific, historical, or statistical research
      9. Enable solely internal uses aligned with your expectations
      10. Otherwise use your personal information internally in a lawful manner compatible with the context in which you provided it
    4. Data Portability. In some jurisdictions, you may have the right to request a copy of your personal information in a structured, commonly used, and machine-readable format.
    5. Do Not Track. Some browsers have a “Do Not Track” feature that signals to websites that you visit that you do not want to have your online activity tracked. Our Site does not currently respond to “Do Not Track” signals.

If you are located outside the United States, your information may be transferred to, stored, and processed in a country different from your country of residence, including the United States, which may have data protection laws that are different from those in your country. By using our Site or Services, you consent to the transfer of your information to the United States and other countries where we operate.

We retain your information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, or to resolve disputes or enforce our agreements. When determining the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the information, whether we can achieve those purposes through other means, and applicable legal requirements.

    Upon termination of our relationship, we will retain your information in accordance with the “Data Retention and Deletion” provisions in our Master Services Agreement.
  11. California Privacy Rights. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) regarding your personal information, including:
    1. The right to know what personal information we collect, use, disclose, and sell
    2. The right to delete certain personal information we have collected
    3. The right to opt-out of the sale of your personal information
    4. The right to non-discrimination for exercising your privacy rights

  12. Updates to this Policy. We may update this Policy from time to time to reflect changes in our privacy practices or applicable laws.     Your continued use of our Site or Services after we make changes to this Policy constitutes your acceptance of those changes.
